Court Appointed Counsel to FiduciariesGary S. Fergus has been appointed by two bankruptcy courts to represent the court appointed statutory representative of collectively over 40,000 future asbestos victims (United States Bankruptcy Court for the Northern District of California, and United States Bankruptcy Court for the Central District of California). His role has been to assure that those 40,000 future asbestos victims are treated fairly and their interests zealously protected in the allocation of assets of bankrupt corporations that caused injury to these future unknown claimants. The court appointed representative of these future claimants that he has represented is the former Assistant Attorney General of the United States and former United States District Court Judge, the Honorable Charles B. Renfrew. Based upon our efforts, we have helped to preserve well over a billion dollars to compensate these future asbestos victims over the next 50 years. XII. Enron Appointment by the Bankruptcy Court for the Southern District of New YorkGary S. Fergus was appointed by the United States Bankruptcy Court for the Southern District of New York to represent the Enron estate in connection with the investigation by the Federal Energy Regulatory Commission, the California Attorney General, and California State Senate Select Committee into Enron’s wholesale electricity trading practices. As a result of Mr. Fergus’ representation, the California Attorney General, the California Public Utilities and the Attorney Generals of the State of Washington and Oregon recently entered into a global settlement with Enron resolving all disputes with those entities and governmental agencies. This settlement has been approved by the Enron bankruptcy court, as well as the Federal Energy Regulatory Commission.
